Terms of Service

IMPORTANT: These Terms of Service constitute a legally binding agreement between you and SkimBoards Communications LLC regarding your use of our telecommunications services.
1. Definitions
"Company," "We," "Us": SkimBoards Communications LLC, a Texas limited liability company.
"Services": SMS messaging, voice calling, verification services, and related APIs.
"User," "You": Any individual or entity accessing or using the Services.
"Content": Any data, text, or media transmitted through our Services.
2. Acceptance of Terms
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
3. Description of Services
SkimBoards Communications provides business communication services including:
- Application-to-Person (A2P) and Person-to-Application (P2A) messaging
- Voice over IP (VoIP) and PSTN connectivity
- Two-factor authentication (2FA) and one-time password (OTP) delivery
- Phone number provisioning (long codes, short codes, toll-free)
4. Account Registration and Security
You must provide accurate, current, and complete information during registration. You are responsible for:
- Maintaining confidentiality of API keys and account credentials
- All activities occurring under your account
- Immediately notifying us of unauthorized use
5. Acceptable Use Policy (AUP)
You expressly agree NOT to use the Services for:
- Prohibited Content: Spam, phishing, fraud, malware, hate speech, harassment, or illegal activities
- Regulatory Violations: Violating TCPA, CAN-SPAM, GDPR, or other telecommunications regulations
- Unauthorized Messaging: Sending unsolicited bulk messages without proper consent
- Snowshoeing: Distributing similar content across multiple numbers to evade filters
- Number Harvesting: Scraping or collecting phone numbers without consent
- High-Risk Activities: Emergency services, 911, or life-safety critical systems without explicit written agreement
6. Compliance Obligations
You must comply with:
- TCPA: Telephone Consumer Protection Act (47 U.S.C. ยง 227)
- CTIA Guidelines: Messaging Principles and Best Practices
- GDPR: General Data Protection Regulation (EU) 2016/679
- CCPA: California Consumer Privacy Act
- A2P 10DLC: Campaign registration requirements for business messaging
You are solely responsible for obtaining proper consent before sending messages and maintaining opt-out lists.
7. Fees and Payment
Services are billed according to our published pricing. You are responsible for all charges incurred under your account. Failure to pay may result in service suspension.
8. Termination
We reserve the right to suspend or terminate your account immediately for:
- Violations of this AUP or applicable laws
- Spam complaints or high opt-out rates
- Fraudulent activity
- Non-payment of fees
9. Limitation of Liability
To the maximum extent permitted by law, SkimBoards Communications shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.
10. Governing Law
These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
